These Terms govern claimadvisors.in and the services offered by Vagmi Legal Ventures LLP, operating as Claim Advisors ("we", "us" or "our"). By registering a case, submitting information, paying an agreed fee or continuing to use the service, you accept these Terms, the Privacy Policy and the Refund and Cancellation Policy.
1. Eligibility
You must be at least 18 and legally capable of contracting. When information concerns another person, you confirm that you are authorised to provide it and give the required consent.
2. Our service
We assess insurance grievances and may prepare and pursue them through the insurer, IRDAI, the Insurance Ombudsman and, where appropriate, consumer commissions or courts. We are a policyholder advocacy service, not an insurer, insurance broker or insurance agent. We do not sell or solicit insurance and act only for policyholders.
Claim Advisors is not a law firm and does not itself practise law. Legal advice and representation before a forum or court is provided by an independent empanelled advocate whom the customer engages. No outcome or recovery is guaranteed; results depend on facts, policy wording, evidence, law and the decision-maker.
3. Accounts and security
You must provide accurate and complete information, protect login and one-time-code access, and notify us promptly of suspected unauthorised use. We may suspend access to protect the account, other users or the service.
4. Permitted use and intellectual property
You receive a limited, personal, non-transferable and revocable right to use the site for a genuine insurance grievance. The Claim Advisors name, logo, site, content and tools are owned by us or our licensors. Case documents prepared for you may be used for your case but not copied, resold or reused for another matter without permission.
5. Your responsibilities
- Provide true, accurate and complete information and unaltered documents.
- Use the service only for a genuine grievance you are authorised to pursue.
- Cooperate with reasonable requests for evidence, instructions and deadlines.
- Do not upload harmful code, impersonate another person, infringe rights, disrupt the service or attempt unauthorised access.
False or misleading information may result in the case being declined or closed.
6. Fees and taxes
- Consultation, document review and merit assessment are free.
- If we accept the case, a one-time registration fee of INR 499 inclusive of GST is payable.
- On success, the fee is 15% of the amount actually recovered at company or Ombudsman level, plus GST at the applicable rate on our fee.
- The calculator is an estimate, not a binding quotation.
- Independent advocate fees, filing fees and third-party costs are separate and will be disclosed before they are incurred.
7. Third parties
The service may involve insurers, regulators, independent advocates and external websites. We do not control their systems, timelines or decisions. References to them do not imply endorsement.
8. Disclaimers
We provide the service with reasonable care and skill, but the website and service are otherwise offered on an as-available basis to the extent permitted by law. Nothing excludes rights that cannot legally be excluded, including consumer rights.
9. Liability
To the extent permitted by law, we are not liable for third-party decisions or delays, indirect or consequential loss, or an expected recovery that does not materialise. Except for liability that cannot be limited, our aggregate liability connected with a case is limited to the fees actually paid to us for that case.
10. Suspension, cancellation and termination
You may stop using the service subject to accrued fees and the Refund Policy. We may suspend or close a case where these Terms are breached, information is false, continuing would be unlawful, or the case cannot reasonably be pursued. Rights and fees already accrued survive termination.
11. Governing law and disputes
These Terms are governed by Indian law. We first try to resolve disputes through the Grievance Officer. Subject to statutory consumer rights, courts at New Delhi have jurisdiction. Arbitration applies only where both parties separately agree in writing, before a sole arbitrator seated at New Delhi under the Arbitration and Conciliation Act, 1996; it does not require a consumer to surrender a statutory forum.
12. General
If a provision is unenforceable, the remainder continues. Delay in enforcing a right is not a waiver. Events beyond reasonable control may excuse delay. These Terms, the incorporated policies and any signed engagement form the agreement for the service.
